‘LAWYER UP’: Dems immediately put Trump on notice amid Republicans’ midterm bloodbath

Democrats wasted little time putting the Trump administration on notice after their sweeping midterm victories, firing off blunt warnings of subpoenas and investigations as they prepared to wield newfound power on Capitol Hill.

“LAWYER UP,” Rep. Robert Garcia, D-Calif., the top Democrat on the powerful House Oversight Committee, posted on X.

Sen. Ron Wyden, D-Ore., offered an even more succinct preview of what could be ahead with the signle word post: “Subpoenas.”

As election results rolled in Tuesday night the picture for the next two years became increasingly bleak for Republicans and President Donald Trump’s agenda..

DEMOCRAT SEIZE HOUSE CONTROL IN STUNNING BLUE TSUNAMI, VOW RETRIBUTION AGAINST TRUMP ADMIN

Rep. Delia Ramirez, D-Ill., rattled off a list of Trump administration officials and allies she appeared eager to haul before Congress.

“Noem, Markwayne, Miller, Homan, Bovino, what’s up? Clear your schedule,” Ramirez wrote.

“They are going to need to plant new forests for all of the subpoenas we’ll be printing,” Sen. Ed Markey, D-Conn. , wrote on X.

The warnings offered an early glimpse of the investigations that could consume Washington when the new Congress convenes in January. Democrats are preparing to use committee gavels and subpoena power to scrutinize Trump and his administration after two years in the minority and little ability to move the needle at all.

Democrats have spent months laying the groundwork for this moment, mapping out investigations and sending document requests that could be followed by subpoenas once they take control of congressional committees.

KATHY HOCHUL ‘EXCITED’ ABOUT PROSPECT OF DEMOCRATS TYING TRUMP UP IN INVESTIGATIONS

Garcia, who is in line to chair the House Oversight Committee, has said his panel would move quickly on investigations spanning the Trump family’s business dealings, immigration enforcement, alleged corporate corruption and the handling of the Jeffrey Epstein files.

“We’re not starting from scratch here,” Garcia told Punchbowl News ahead of the election, saying his team had been quietly preparing for months.

Garcia has also pointed to the tools that come with the majority — including subpoenas, contempt proceedings and the ability to take disputes to court — as Democrats prepare for likely resistance from the White House.

The coming investigations are expected to extend well beyond the Oversight Committee.

Democrats on the House Judiciary and Homeland Security committees have spent the past two years pressing the administration over immigration enforcement and other Trump policies, while Senate Democrats could use their newly won committee gavels to launch investigations of their own.

War Secretary Pete Hegseth could face particularly intense scrutiny.

Democrats had already introduced articles of impeachment against Hegseth before taking the majority, accusing him of offenses ranging from waging an unauthorized war against Iran to obstructing congressional oversight. House Minority Leader Hakeem Jeffries went further last month, declaring that “one of the first things” Democrats would do in the majority would be to “run Pete Hegseth out of town.”

Hegseth could face a reckoning even sooner considering Rep. Thomas Massie, R-Ky., has said he plans to force a vote on his own resolution to impeach the secretary when lawmakers return for the lame-duck session. He has accused Hegseth of violating the War Powers Resolution during the Iran war and acting unlawfully in U.S. military operations in Venezuela, Yemen and against suspected drug traffickers.

Congressional committees have broad investigative powers, including the authority to subpoena administration officials and private citizens to testify under oath and compel them to turn over documents, communications and other records.

Committee chairs can also wield significant power on their own. House rules allow committees to delegate subpoena authority to their chairs, meaning some incoming Democratic chairmen could issue demands for testimony or documents without first securing Republican support.

Ignoring a congressional subpoena can trigger contempt proceedings, although forcing compliance — particularly from executive branch officials who invoke privilege — can lead to lengthy legal battles. Congress can pursue contempt of Congress or seek enforcement through the federal courts.

Former Trump advisers Steve Bannon and Peter Navarro were both convicted of contempt of Congress after refusing to comply with subpoenas from the House committee investigating the Jan. 6 Capitol attack, and each was sentenced to four months in prison.

Congress can vote to hold a witness in criminal contempt and refer the matter to the Justice Department, which retains a role in deciding whether to pursue prosecution, a significant hurdle when Congress is seeking information from officials serving in the executive branch.
